Alcohol Compliance Check in Black Hills Nets One Violation in New Underwood

RAPID CITY, S.D. – The Pennington County Sheriff’s Office conducted compliance checks on county alcohol establishments on September 24, 2025, finding one business in violation of South Dakota law.

A total of 11 businesses were checked in the Rapid City area and surrounding Black Hills communities. One establishment was cited for selling alcohol to an underage informant working with law enforcement.

The business that sold alcohol to the underage informant was BJ’s Country Store, located at 16098 Highway 14/16 in New Underwood. An employee was issued a citation for violating South Dakota codified law 35-9-1.1, which prohibits furnishing alcohol to an individual between the ages of 18 and 20.

The violation is classified as a class 2 misdemeanor, which is punishable by up to 30 days in jail or a $500 fine, or both. Businesses face potential fines of $1,000 for a first offense and $2,000 for a second offense. A third offense could result in the loss of a liquor or business license.

The following businesses in Pennington County were found to be in compliance: Moe’s Bar and Grill in New Underwood; The Wasta Bar in Wasta; and Wall Auto Livery, BJ’s Convenience Store, Red Rock Restaurant, Hansen Inn, Badlands Saloon & Grill, Salty Steer, Wall Food Center, and Common Cents, all in Wall.

The charges are merely accusations and the arrested individual is presumed innocent until proven guilty. Any additional details regarding this case can be obtained from the Pennington County State’s Attorney or court records as appropriate.
