RAPID CITY, S.D. – A Rapid City man has been sentenced to 12 years in the South Dakota State Penitentiary after pleading guilty to fourth degree rape and distribution of a controlled substance to a minor. The sentences for 39-year-old Jordan Thayer will be served concurrently.
Thayer was arrested on October 16 and originally charged with multiple counts, including second degree rape by force, coercion, or threats, and fourth degree rape where the victim is a minor between the ages of 13 and 16 and the perpetrator is at least three years older. He was also charged with distribution of a controlled drug to a minor. Thayer pleaded guilty to the fourth degree rape charge and the drug distribution charge in May.
The crimes took place in 2022 and 2023 and involved a 15-year-old girl. Chief Deputy State’s Attorney Gina Nelson said Thayer exploited the teenager by providing her with methamphetamine and using physical force to ensure her compliance. Thayer’s attorney stated to the court that her client was not aware of the victim’s age at the time of the offenses.
Judge Heidi Linngren noted Thayer’s three prior felony drug convictions and emphasized her concern that he had not addressed his addiction despite multiple opportunities. She stated that his addiction was at the root of these crimes and is what makes him dangerous.
“This case demonstrates how drug addiction fuels dangerous and criminal behavior,” Nelson said. “Thayer’s actions left a lasting impact on the victim. This sentence holds him accountable and sends a clear message that such conduct will not be tolerated.”
Fourth degree rape is a Class 3 felony, punishable by up to 15 years in prison and a $30,000 fine. Distribution of a controlled substance to a minor is a Class 2 felony, carrying a penalty of up to 25 years in prison and a $50,000 fine. The case was prosecuted by Deputy State’s Attorney Emma Kalkowski-Farrand.
